Kieran Looney v Trafigura Beheer BV

On 1 February Mr Justice Newey dismissed a claim brought by Kieran Looney against Trafigura.

Mr Looney had been engaged by Trafigura to provide management training for senior executives. His contract was terminated after one year, in reliance upon a termination clause. Mr Looney alleged that the contract had been repudiated by Trafigura, and that the termination was unlawful.

Following a 9 day trial in the Chancery Division, Newey J dismissed the claims, holding that Trafigura had not repudiated the contract, and that the termination had been made in accordance with the terms of the contract. The Judge refused to imply a term into the contract to the effect that Trafigura would only terminate the contract on reasonable grounds; but said that in any event Trafigura did act reasonably in terminating the contract.
